Public offer agreement for the provision of tourist and other services on the website of Leningrad-Tour LLC

1. GENERAL PROVISIONS
This document is an official offer (public offer) of the Limited Liability Company «Leningrad-Tour», hereinafter referred to as Leningrad Tour LLC, Tour Operator registry number RTO 020659, and contains all essential terms for the sale of a tourist product or the provision of excursion services via the Internet resource leningrad-tours.ru
In accordance with Part 1 of Article 433 of the Civil Code of the Russian Federation, an agreement is recognized as concluded at the moment the person who sent the offer receives its acceptance.
In accordance with paragraph 2 of Article 437 of the Civil Code of the Russian Federation (hereinafter referred to as the Civil Code of the Russian Federation), a public offer is a proposal containing all the essential terms of the agreement, from which the will of the person making the proposal is apparent to conclude an agreement on the terms specified in the proposal with anyone who responds to this proposal.
Acceptance is the response of the person to whom the offer is addressed regarding its acceptance (paragraph 1 of Article 438 of the Civil Code of the Russian Federation). The performance by the person who received the offer, within the period established for its acceptance, of actions to fulfill the terms of the agreement specified therein (payment for services, etc.) is considered acceptance, according to paragraph 3 of Article 438 of the Civil Code of the Russian Federation.
If the conditions set out below are accepted, the individual accepting this offer becomes the Customer (acceptance of the offer is equivalent to concluding an agreement on the terms set out in the offer).
Please note that the agreement is terminated (cancelled) unilaterally if the tourist fails to appear at the start of the tour.
By taking actions to accept this public offer agreement, the Customer confirms the legal right to enter into contractual relations with Leningrad-Tour LLC.

If you do not agree with any clause of this Offer, you must refuse to conclude this agreement

2. TERMS
In this public offer, the following terms are used with the following meanings:
Leningrad-Tour LLC - Limited Liability Company «Leningrad-Tour», vested with the right to sell a tourist product, registry number RTO 020659.
OFFER - this document «Public Offer Agreement for the Provision of Tourist Services», published on the Internet at the address leningrad-tours.ru
ACCEPTANCE OF THE OFFER - full and unconditional acceptance of the terms of the offer by the Customer performing actions expressing the intention to use the website of Leningrad-Tour LLC to arrange services.
WEBSITE, SITE- an openly available for free visual review, publicly accessible resource owned by Leningrad-Tour LLC, located on the Internet at leningrad-tours.ru, through which information about the date, program, availability of places and cost of the services provided (tourist product) is displayed.
OFFER AGREEMENT - an agreement between Leningrad-Tour LLC and the User for the provision of booking, arrangement and sale services for a tourist product, insurance, accommodation and other services, which is concluded by acceptance of the offer.
USER - an individual who has the legal right to enter into contractual relations with Leningrad-Tour LLC.
CUSTOMER, TOURIST - a User who has accepted the offer and is thus the Customer of Leningrad-Tour LLC services under the concluded offer agreement.
ORDER - a duly executed request by the Customer for the services selected on the website leningrad-tours.ru
TOUR, TOUR PRODUCT - services described on the Website and offered to Tourists. The complex of tourist services constituting the tourist product may include:
- transportation services, transfer;
- excursion services.
PAYMENT - funds transferred by the Tourist to Leningrad-Tour LLC to pay for booked tours.
AUTHORIZATION - the process of server-side analysis of the identification data entered by the Tourist (information used to establish the authenticity of the claimed identity), based on the results of which the Tourist's right to receive the Services and/or use the Tourist interface is determined.
INTERNET ACQUIRING - acceptance of cards for payment via the Internet using a specially developed web interface from banks or payment systems that allows making payments in online stores.
SUPPORT SERVICE - a department of Leningrad-Tour LLC that daily, during working hours, monitors incoming Orders and maintains feedback with Users and Customers by phone 8 (969) 200-15-77, 8 (969) 200-66-50 or by email: leningrad-tour@yandex.ru.

3. SUBJECT OF THE OFFER
Leningrad-Tour LLC undertakes to provide the Customer with services for booking, processing and selling the tourist product in accordance with the terms of this offer, and the Customer undertakes to pay for the services at the established price.
This public offer agreement is considered concluded (acceptance of the offer) from the moment the Customer confirms their consent to its terms by full payment, after which the public offer agreement is considered the basic document in the official relationship between the Customer and the Agency.

4. TERMS AND PROCEDURE FOR THE PROVISION OF SERVICES
In order to use the services of Leningrad-Tour LLC, the User must necessarily complete the registration procedure on the website leningrad-tours.ru
During registration, the User must provide the following data:
- last name, first name, patronymic;
- email address (subsequently used as login);
- contact phone number.
When placing an order, it is possible to go through an express registration procedure by providing only a contact phone number, however subsequently, upon payment, the User undertakes to provide all the above data.
After completing the registration procedure, the User is responsible for the safekeeping of their registration data and confirms that all actions performed using this data are carried out by them personally or with their consent.
The User confirms the accuracy of the personal data they enter while using the website leningrad-tours.ru, as well as the data of accompanying tour participants, and assumes full responsibility for their accuracy, completeness, and reliability.
Changing the personal data of any trip participant in a placed Order requires immediate contact with Leningrad-Tour LLC, as changing this entered data may require modifying the order and placing a new one. Thus, the Customer assumes all possible commercial risks (ticket refunds, placing a new order, fare changes, refunds, etc.) associated with their culpable actions of making errors and inaccuracies in providing the personal data of trip participants.
The services of Leningrad-Tour LLC are provided in full subject to full payment by the Customer of the published payments.
After the Customer makes payment of the published payments and the funds are credited to the settlement account of Leningrad-Tour LLC or the payment is displayed in the database of the bank that provided internet acquiring, the contract is considered concluded.
Leningrad-Tour LLC reserves the right to refuse the Customer the provision of services or to additionally request copies of the cardholder's documents if there are sufficient grounds to believe that the transaction on the plastic card used to pay for the order may be recognized as fraudulent.

5. SETTLEMENTS AND PAYMENT PROCEDURE
5.1. Booking and payment.
To carry out the Tour booking procedure, the Tourist fills out the Tour order form on the website.
One-day tours around Saint Petersburg and its suburbs (with some exceptions) do not require passport data.
Multi-day tours require full passport data (Last name, First name, Patronymic, date and place of birth, date and issuing authority of the passport, registration address).
After coordination with the travel agency manager, the Tourist can pay for the placed order through their personal account. The contract is considered paid from the moment full payment for the tour is received in the settlement account of Leningrad-Tour LLC. Payment for the tour is made online in the personal account or at the office using a plastic card on the day of the order. In case of a price change or cancellation of the booking, the tourist can withdraw the money back to the card, minus the actual expenses incurred by Leningrad-Tour LLC, by sending a refund request to the email address - leningrad-tour@yandex.ru.
5.2. Cost of the tour package.
Leningrad-Tour LLC reserves the right to increase or decrease prices for tourist packages, but guarantees that the price of a timely paid tourist package remains unchanged. The total price of the tourist product booked by the Tourist and transferred to Leningrad-Tour LLC under the contract is indicated accordingly in the Booking Request and in the Contract. The price of the tourist product is determined by the tour operator and is set in rubles. In case of late payment for the tour, the price may be changed (increased or decreased), and accordingly the contract price is recalculated both upward and downward. In such case, the contract price changes, and the tourist has the right to accept such changes or to terminate this contract in writing, with reimbursement of the actual expenses incurred by Leningrad-Tour LLC.
The Tourist has been informed about the terms of tour cancellation and its consequences (reimbursement of the Tour Operator's actual expenses). At the moment of concluding this contract, the Tourist has received information about the consumer properties of the tourist product: about the stay program, route and travel conditions, including information about accommodation facilities, transportation services, and additional services necessary for the Tourist.
5.3. What the price of the tour includes.
Please note. The composition of each specific tourist product is provided on the website.
As a rule, it includes: excursion and transport services, entrance tickets. For tours lasting more than one day - excursion and transport services, accommodation and meals as specified in the program.
5.4. Accuracy of the catalog and descriptions of the tourist product.
All information about tour and excursion programs, accommodation, and prices provided in the descriptions is verified by the travel organizers' staff. The Tourist confirms that they have read the information about the tourist product posted on the website leningrad-tours.ru
5.5. Cancellation of a booking at the Tourist's initiative.
The Tourist has the right to cancel a confirmed order for a booked tour. The cancellation request must be submitted in electronic or written form and signed, or accepted by the person who made the booking. The date of cancellation of the order shall be the day (excluding weekends and holidays) on which OOO «Ленинград-Тур» receives an email from the Tourist. In the event of modification or termination of the contract and (or) the Tourist's refusal to perform the contract and (or) the Tourist's refusal of the confirmed tourist product and (or) cancellation of the order by the Tourist, the Tourist is obliged to reimburse OOO «Ленинград-Тур» for the expenses incurred in performing the contract. Expenses in this case mean the expenses actually incurred by OOO «Ленинград-Тур» aimed at fulfilling the Tourist's order, including funds spent up to the moment of receiving from the Tourist a written notice of modification or termination of the contract and (or) the Tourist's refusal to perform the contract and (or) the Tourist's refusal of the confirmed tourist product and (or) cancellation of the order by the Tourist.
5.7. Procedure for reviewing claims.
5.7.1. The task of OOO «Ленинград-Тур» is to ensure the program stated on the website; however, in the event of any claims regarding the quality of the services provided, the Tourist must contact the representative of the travel organizer - at the office by phone: +7 (969) 200-15-77, 8-969-200-66-50.
5.7.2. If the problem situation is not resolved on site, claims regarding the quality of the tourist product are submitted by the Tourist in writing within 7 days from the end of the contract and are subject to review within 10 days from the date of receipt of the claims.

6. OBLIGATIONS OF THE PARTIES
6.1. OOO «Ленинград-Тур» undertakes to provide the Tourist with information:
- about the consumer properties of the tourist product;
- about shrines, natural, historical, cultural monuments and other tourist attractions (to the extent necessary for the trip);
- about the dangers the Tourist may encounter during the trip;
- about timely notification when purchasing a tourist product.
OOO «Ленинград-Тур» is not liable and does not pay any compensation for expenses incurred by the Tourist if, by decision of the responsible persons, the Tourist was denied excursion services for the following reasons: violation of public order, state of alcohol or drug intoxication, as well as other violations, such as: storage, transportation or distribution of drugs, illegal storage or carrying of weapons, etc.
The Tourist confirms that they have read the specified information and received the relevant materials.
6.2. OOO «Ленинград-Тур» is not liable and does not offer compensation in cases of changes to the tour program for reasons beyond its control, namely: bodily injury, loss of belongings and documents, flight delays and rescheduling, technical breakdowns and mechanical damage to transport, city closures, cancellation of bus and ferry services caused by extreme weather conditions, wars, etc., i.e. events of a force majeure nature (force majeure circumstances), and other reasons beyond the control of OOO «Ленинград-Тур».
6.3. When using the Website, the Tourist undertakes to comply with these Terms and Conditions of Use. The conclusion of the Contract by the Tourist with OOO «Ленинград-Тур» is carried out by acceptance of the public offer through the sequential performance of the following actions expressing their will to establish a legal relationship:
6.3.1. Familiarization with the terms of this Contract on the use of the Website, appendices and agreements to this Contract governing the relations of the parties and posted on the Website;
6.3.2. Registration on the company's website: leningrad-tours.ru;
6.4. The Agreement is deemed concluded by the parties from the moment all of the above actions are performed. Conclusion of the Agreement means that the Tourist has, to the extent necessary for them, familiarized themselves with the terms of service provision and the operation of the Website, and acknowledges the unconditional suitability of the offer for performing the actions described on the Website and in this Agreement. Receipt by Leningrad-Tour LLC of funds and recording in the Register of booked tours confirms that the Tourist has performed the actions listed in clause 6.3.
6.5. To receive services through the System, the Tourist must provide personal identification data — the Tourist's Name and Email (Login).
From the moment of acceptance of this public offer, the Tourist is a participant in the System solely with respect to receiving and further using this agreement in the form of an electronic document.
6.6. Amendments (additions) to this agreement, and changes to the procedure, scope and terms of service provision, are made by agreement of the Parties to this Agreement. All amendments (additions) made to this agreement by agreement take effect and become binding on all persons who are Parties to this agreement. In case of disagreement with the amendments to this agreement, a Party has the right to terminate this Agreement in accordance with the procedure set out herein. All amendments and additions to this Agreement are an integral and inseparable part hereof.

7. LIABILITY OF THE PARTIES
7.1. Leningrad-Tour LLC is not liable for interruptions in the provision of Services in the event of failures of software or equipment not owned by Leningrad-Tour LLC.
7.2. Leningrad-Tour LLC is not liable for full or partial interruptions in the provision of Services related to the replacement of equipment or software, or other work caused by the need to maintain the operability and upgrade of software and/or hardware.
7.3. Leningrad-Tour LLC is not liable for the functioning and availability of individual segments of the Internet.
7.4. Leningrad-Tour LLC does not guarantee the possibility of information exchange with those nodes or servers that are temporarily or permanently unavailable via links posted on the Website.
7.5. Leningrad-Tour LLC is not liable for any consequences undesirable for the Tourist arising from the provision of telephone consultation to the Tourist.
7.6. Leningrad-Tour LLC is not liable for the failure to record the Tourist's Payment in the system if this payment does not arrive in the Travel Company's settlement account.
7.7. Leningrad-Tour LLC is not liable for ensuring the security of the Tourist's technical equipment and software used to receive the Services.
7.8. Leningrad-Tour LLC does not request or store PIN and CCV2 codes for plastic cards and is not liable for their safekeeping if they are accidentally or intentionally disclosed to managers. All transactions involving the withdrawal of funds from plastic cards via Internet acquiring are performed on a third-party resource provided by the Bank under the Internet acquiring agreement (PAYLER-CISB).
7.9. The Tourist is liable for fulfilling their obligations under the Agreement in accordance with the legislation of the Russian Federation.
7.10. The Tourist is not entitled to use the services provided by Leningrad-Tour LLC in entrepreneurial or intermediary activities.
7.11. In the event of an unjustified chargeback of a payment made by the Tourist to the account of Leningrad-Tour LLC using their Visa, MasterCard, Maestro, MIR, etc. plastic card, the Tourist is obliged to reimburse Leningrad-Tour LLC funds in the amount of one hundred percent of the amount of the payment withdrawn from the issuing bank and the losses incurred by Leningrad-Tour LLC and the issuing bank of the bank card.
7.12. The Tourist bears sole responsibility and the risk of adverse consequences in the event of inaccuracy or unreliability of the data transmitted to Leningrad-Tour LLC through the special Tourist interface for performing the required actions.
7.13. The Tourist bears sole responsibility for complying with the agreement on the use of the System, applications, and the agreement and provisions to this agreement posted on the website. In the event of violation of the obligations defined by the above documents, Leningrad-Tour LLC has the right to temporarily suspend the provision of both all Services received by the Tourist under the Agreement and individual Services.
7.14. The Tourist shall be solely responsible in accordance with the legislation of the Russian Federation for all actions taken through the use of the Services, as well as their consequences.
7.15. The Tourist shall be solely responsible for any (including unauthorized) actions of third parties that occurred during the use of the analogue of a handwritten signature, as well as their consequences, before Leningrad-Tour LLC and third parties.
7.16. By providing their personal (personal) and identification data during registration and filling out the "profile", as well as personal data about other persons (accompanying participants of the tour), the Tourist guarantees their authenticity and agrees to their further processing and verification by Leningrad-Tour LLC. In case of unreliability of the personal identification data provided by the Tourist, as well as personal data about other persons (accompanying participants of the tour), Leningrad-Tour LLC has the right to terminate this Agreement unilaterally.
7.17. By accepting this offer, the Tourist recognizes the use of the ASP to confirm the authenticity and authenticity of the operations used in the System, while the Tourist confirms that electronic documents and data received from the System and generated by them for the System are considered by the Tourist as a legally significant document drawn up in writing, originating and signed by the sender according to all the rules of traditional document execution in writing.
7.18. At the same time, the Tourist grants Leningrad-Tour LLC the right to send informational materials to their email address notifying about the services provided.
7.19. The Tourist considers this Agreement as a document in writing, drawn up according to all the rules of traditional document execution in writing, duly signed by each of the Parties.
7.20. This Agreement may be amended or terminated by agreement of the parties or on other grounds provided for by applicable law or this agreement.
7.20.1. Each of the parties has the right to demand amendment or termination of this agreement due to a significant change in the circumstances from which the parties proceeded when concluding the agreement. Significant changes in circumstances include:
- deterioration of travel conditions;
- change in the dates of the travel;
- impossibility of the Tourist to make the trip due to circumstances beyond their control (illness of the Tourist and other circumstances) upon provision of certificates/documents, etc.
7.20.2. In case of amendment or termination of the agreement and (or) refusal of the Tourist to perform the agreement and (or) refusal of the Tourist from the confirmed tourist product and (or) cancellation of the order by the Tourist, the Tourist is obliged to reimburse Leningrad-Tour LLC for the expenses incurred in the performance of the agreement. Under the expenses of Leningrad-Tour LLC in this case are understood the actually incurred expenses aimed at fulfilling the order of the Tourist, including funds transferred by Leningrad-Tour LLC to transport companies, etc. until the receipt from the Tourist of written notice of amendment or termination of the agreement and (or) refusal of the Tourist to perform the agreement and (or) refusal of the Tourist from the confirmed tourist product and (or) cancellation of the order by the Tourist).
7.21. Untimely payment by the Tourist of funds under this Agreement, failure to provide the documents required by Leningrad-Tour LLC, information necessary for the performance of the agreement, are considered by the parties as a unilateral refusal of the Tourist to perform the Agreement with the application of the consequences provided for in clause 7.20.2 of the agreement.
7.22. Leningrad-Tour LLC has the right to withhold the remuneration due to it and the amount of expenses incurred by Leningrad-Tour LLC in the performance of the Agreement from the funds paid by the Tourist to the Travel Agency in fulfillment of the agreement.
7.23. FORCE MAJEURE CIRCUMSTANCES
Leningrad-Tour LLC shall be released from liability for partial or full non-performance of obligations under this Agreement if such non-performance occurred as a result of force majeure circumstances, including earthquakes, floods, tsunamis, fire, typhoons, snow drifts, military actions, mass diseases, strikes, transportation restrictions, prohibition of trade operations with certain countries, terrorist acts and other circumstances beyond the control of Leningrad-Tour LLC. In the event of force majeure circumstances, each party has the right to terminate the Agreement with the consequences provided for in clause 7.20.2 of this agreement.

8. PROCEDURE FOR AMENDING AND TERMINATING THIS PUBLIC OFFER AGREEMENT
The Agency reserves the right at any time to make changes to the terms of this public offer agreement; if the effective date of the changes is not specifically stipulated, they take effect from the moment they are published on the Leningrad-Tour LLC Website at leningrad-tours.ru
The Customer's use of the Leningrad-Tour LLC Website after changes are made to the offer agreement is unequivocally understood by Leningrad-Tour LLC and the Customer as acceptance of the changes made.
This agreement may be terminated at any time at the initiative of the Customer or Leningrad-Tour LLC by sending the other party a corresponding notice by mail.
Leningrad-Tour LLC has the right to terminate the agreement at any time without prior notice in the event of the Customer's violation of the procedure and deadlines for booking and payment for services.

9. TERM OF THE OFFER AGREEMENT
The Agreement comes into force from the moment of its conclusion (acceptance of the offer) and is valid for the duration of the services provision.
